THE BOATHOUSE HOTEL PATONGA

ACCOMMODATION TERMS + CONDITIONS

1. The Boathouse Hotel Patonga reserves the right to refuse any booking without the necessity to give reasons for such refusal to the Customer.

2. No Accommodation may be used for functions, parties or events and all Bookings are for personal use only and are non-transferrable.

3. Reservations

a. Except at the discretion of The Boathouse Hotel Patonga, reservations and tentative bookings do not constitute any commitment by us to accept your Accommodation request.

b. All Bookings must contain the correct number of guests, such number must not exceed the maximum capacity of the Accommodation. We reserve the right to charge additional Fees for guests

c. During Peak Periods, we may impose different payment requirements and amounts in respect of Fees/Deposits, different cancellation terms and other terms as advised by us.

d. We reserve the right to impose minimum nights stay requirements at any time.

4. Pets

a. Unfortunately, The Boathouse Hotel Patonga Beach does not permit pets to stay or visit in our Accommodation.

5. Incidentals, Damage and Your Security Credit Card

a. The Customer is liable for any loss, damage or injury suffered by The Boathouse Hotel Patonga, it's employees, contractors and/or agents and any loss or damage caused to the accommodation, our equipment, furniture, fixtures, fittings, systems, decorations or other property to the extent that such loss, damage or injury is caused or contributed to by the Customer and/or any of its employees, contractors or guests.

b. Without limiting any other provision of this Agreement, the Customer acknowledges and agrees that The Boathouse Hotel Patonga may charge the Security Credit Card for such amount as is required to cover any loss, damage, costs, claims, expenses and liabilities incurred as a result of any action, inaction or any breach of this Agreement on the part of the Customer, its employees, contractors or guests. For the avoidance of doubt, the Customer is liable for the actions of each of its invitees.

6. Car Parking and Your Goods

a. The Venue does not have storage facilities other than the Accommodation booked by the Customer.

b. We do not have parking facilities so we cannot guarantee parking.

c. To the extent permitted by law, in particular to the extent permitted by the Inkeepers Act 1968 (NSW), The Boathouse Hotel Patonga will not accept any responsibility for any damage, theft or loss of goods and valuables during your stay. In the event that we cannot exclude liability, such liability is capped at $100.

d. All goods must be removed at the conclusion of your stay. Any goods left without prior arrangement will be deemed abandoned and will be dealt with by us in accordance with the Uncollected Goods Act 1999 (NSW).

7. Directions

a. In the event of an emergency, the Customer and guests will follow the directions our staff to evacuate the Accommodation if instructed to do so.

8. Observance of Laws

a. The Customer and its guests shall in all respects observe and comply with the provisions of all relevant State or Federal legislation.

9. Use of Accommodation

a. The Customer shall conduct and use the Accommodation in a proper, orderly and lawful manner and shall not permit any act, matter or thing which may injure the reputation of The Boathouse Hotel Patonga or cause loss or damage to any person or property and may not disrupt the quiet use and enjoyment of other guests.

b. We reserve the right to terminate your use of the Accommodation if an incident occurs or you, or your guests are in breach of these terms or any law. We reserve the right to remove a person/s without liability if behaviour is not considered appropriate.

d. The Boathouse Hotel Patonga and our staff adhere to Responsible Service of Alcohol as follows:

• Liquor will not be sold or supplied to a person or persons under the age of eighteen years.

• Proof of age must be provided on request

• We will not permit intoxication or any indecent, violent or quarrelsome conduct on the licensed premises.

• Liquor will not be supplied to any person or persons who are at the time in a state of intoxication. Accordingly, patrons will be denied service if they are considered to be intoxicated.

10. Smoking

a. In the interest of public health, and in line with Government Regulations, the Accommodation is a smoke free venue. No smoking (including e cigarettes) are permitted indoors and guests will be directed to a permitted smoking area.

11. Liability

a. To the extent permitted by law, we do not accept liability to you or your guests for any liabilities, loss, damage or injury arising from or connected to the use by the Customer, its employees, contractors or guests of the Accommodation and/or the consumption of any food or beverages. Use of the Accommodation is at the Customer’s own risk.

12. Personal Information

a. You consent and authorise The Boathouse Hotel Patonga to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.

b. You consent to information which you have provided to us as part of your booking being used by The Boathouse Hotel Patonga or any of their related bodies corporate for the purpose of informing you about offers and promotions which relate to The Boathouse Hotel Patonga and its related bodies corporate.

c. We will not provide or disclose any information you have provided to us to any person other than a related body corporate without your prior written consent.

13. Outstanding Amounts

a. Barrenjoey House Palm Beach will use the credit card provided at the time of booking to process any outstanding amounts after the guest has checked out.

Payment Policy

a. The cost of accommodation will be charged upon booking the stay.

b. Payments made by credit card may incur a surcharge. The surcharge is 1.95% for Visa, Mastercard or 2.95% for Amex.

c. Boathouse gift cards can be used at the time of booking, and must be processed over the phone.

d. If your stay is extended with our agreement, we require you to pre-pay for such additional nights in advance. Where your stay is extended without prior agreement, the rates applicable to any additional hours / days will be charged on a pro rata basis at a rate equivalent to 2 x the average rate applicable during your stay. We may charge such additional fees to your credit card without notice.

Cancellation Policy

a. If a booking is cancelled after it has been confirmed, written notification is required. Where the booking is cancelled 7-14 days out from the commencement of the stay, 50% of the full accommodation price will be refunded to the credit card used to pay for the booking.

b. In the event a booking is cancelled 0-7 days out from the commencement of your stay, the full accommodation price will be forfeited to The Boathouse Hotel Patonga.
